Goffstown ZBA approves ADU variance for undersized lot

NH GOFFSTOWN — Goffstown Zoning Board unanimously approves accessory dwelling unit variance for undersized lot. Vice Chairman Jason Cote presided over the Board's approval of a variance for Sandra Brown Revocable Trust and Lawrence Brown to construct approximately 900 square feet of residential space in an accessory dwelling unit above a one-stall garage addition at 521 Mountain Road, Map 1, Lot 43. The property spans 1.25 acres in the Conservation and Open Space zone, which requires a minimum five-acre lot size.
New Hampshire state law HB577 designates accessory dwelling units as a use by right, but the town ordinance's five-acre lot-size requirement creates an impossible compliance situation on this existing nonconforming property. The Board approved the variance 5-0, conditioned on the ADU not exceeding 950 square feet.
